SnapeFest Terms and Conditions

Introduction

These Terms and Conditions apply to your use of any products, services or websites provided by Snapecast LLC (“Snapecast”). Specifically, without limitation, these Terms and Conditions apply to “the Services” which include your use of the website located at www.snapefest.org (the "Website") and your attendance at the SnapeFest conference on 9 July 2008 in Dallas, Texas (“Snapefest"). By proceeding to use any of the Services, as defined below, you expressly agree to and accept these Terms and Conditions.

Use of Services

You hereby understand and agree: (i) that your use of the Services is at your own risk; (ii) that the Services may not be provided on a continual and uninterrupted basis; (iii) that any material obtained from the Services is at your own discretion and your own risk, and that Snapecast shall not be liable for any damage that occurs to you or your property as a result of your actions; and (iv) that the nature and type of the Services may change at any time and without notice.

Your use of and attendance at the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis. Snapecast expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Attendance Restrictions

The programming, events and activities at SnapeFest are intended primarily for adults. You must be at least 18 years of age to access the Website and other online posting resources associated with Snapecast. You must be at least 21 years of age as of 8 July 2008 to attend SnapeFest.

Snapecast reserves the right to refuse entry to any registrant who disrupts SnapeFest or otherwise causes it to be brought into disrepute. While debate is accepted and encouraged, any registrant acting in an abusive fashion to another person will be asked to leave.

Prohibition on Commercial Use

You hereby agree not to use, copy, reproduce, sell or in any other way exploit any portion of the Services, including without limitation, the text or artwork located on the Website, for any commercial purpose whatsoever without the express prior written permission of Snapecast.

Content

You understand that all information including but not limited to registration information submitted with regard to SnapeFest, submission information provided by you that concerns or regards participation as a speaker, panelist or participant in any portion of SnapeFest, data, text, graphics, messages or other materials (“the Content”) are the sole responsibility of the persons from which such Content originated. You understand that by using Website, and/or attending SnapeFest, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Snapecast be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any

Indemnity

You agree to indemnify and hold Snapecast, and its subsidiaries, affiliates or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Website, your use of the Website, and your attendance at SnapeFest.

Privacy Policy

For all purposes, the Portus Privacy Policy applies to all activities relating to SnapeFest. This Privacy Policy applies to your use of the Services provided by Snapecast including the registration process for SnapeFest and the use of the Website. Governing Law and Jurisdiction

The Terms and Conditions and the relationship between you and Snapecast shall be governed by the laws of the State of Texas. You and Snapecast agree to submit to the personal and exclusive jurisdiction of the courts located within Harris County, Texas.

Waiver and Severability

The failure of Snapecast to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.
